The website MyHatchTech (myhatchtech.com) is offered to you by HatchTech BV, located at Innovatielaan 3 (6745 XW) De Klomp, conditioned on your acceptance without modification of the terms, conditions, and notices contained herein.
If you do not agree to abide by these or any future versions of the Terms of Use, do NOT use or access (or continue to use) MyHatchTech, because by using MyHatchTech you will be deemed to have irrevocably agreed to these Terms which form a legally binding agreement. This agreement may not be assigned or otherwise transferred to a third person. The access code(s) are registered to a named person. It is not allowed to share the access code(s) with other persons or third parties.
The content included in MyHatchTech, including the collection, arrangement and assembly of text, data, graphics, logos, images, software and other material are subject to copyright, patent, trademark and other intellectual property rights, trade secrets and proprietary rights of HatchTech.
Pursuant to the General Data Protection Regulation of May 2016 on protection of personal data, HatchTech shall process personal data (any information relating to an identified or identifiable natural person) if the processing is necessary for the performance of MyHatchTech or any agreement or in order to take steps at your request prior to entering into an agreement. In other cases HatchTech shall obtain the consent of the physical persons whose information it processes and, therefore, you hereby consent to the processing of your personal data furnished within the scope specified in MyHatchTech in connection with performance of any concluded agreement. Your personal data may be furnished by HatchTech to entities of HatchTech (i.e. entities of the HatchTech Group B.V. with the registered office in Veenendaal, the Netherlands), in purposes connected with MyHatchTech and performance of other agreements concluded between HatchTech and you. Moreover, your personal data may be furnished by HatchTech to entities cooperating with or providing services to HatchTech in purposes connected with MyHatchTech and the performance of other agreements concluded by HatchTech and its affiliated entities. HatchTech may transfer the personal data to countries outside the European Union. The controller of the personal information shall be HatchTech B.V. with the registered office in Veenendaal, at the following address: Plesmanstraat 33, 3905 KZ Veenendaal. You shall be entitled to have access to processed information, correct it and revoke the consent at any time.
The information on MyHatchTech includes Confidential Information. Confidential Information shall include all information provided by HatchTech, such as but not limited to concepts, techniques, processes, methods, systems, designs, drawings, calculations, photographs, models, prototypes, software, schematics, research materials, formulas, development or experimental work, work in progress, inventions, cost data, marketing plans, product plans, business strategies, financial information, forecasts, personnel information and customer or supplier lists.
Any user of MyHatchTech shall keep the Confidential Information obtained on MyHatchTech confidential and shall:
- not use or exploit the Confidential Information in any way except if it is necessary for the implementation of the project or with the express prior written consent of HatchTech;
- not disclose or make available the Confidential Information in whole or in part to any third party, except as expressly permitted by HatchTech;
- not copy, reduce to writing or otherwise record the Confidential Information except as strictly necessary for the purpose to use the products and services of HatchTech (and any such copies, reductions to writing and records shall be the property of the HatchTech);
- apply the same security measures and degree of care to the Confidential Information as the user applies to its own confidential information, which the user warrants as providing adequate protection from unauthorised disclosure, copying or use.
HatchTech may access or disclose information about you, or your use of MyHatchTech:
- when it is required by law (such as when we receive a valid subpoena or search warrant);
- to respond to your requests for service support;
- to our agent;
- for statistics purposes and further improvement of MyHatchTech and the security thereof;
- when we, in our discretion, think it is necessary to protect the rights, property, or personal safety of HatchTech and its subsidiaries, affiliates, agents, partners, licensors, suppliers or customers.
The user and customer expressly agree to disclosure of content (such as Confidential Information of the user or the customer) available on MyHatchTech to our agent and to any third party which the customer grants permission to access. The customer shall be solely responsible for accurate control of the user(s) who have permission to access. The customer can withdraw its permission at any time by reporting this to the International Sales Manager.
The content included in MyHatchTech is for information purposes only and is not intended as a substitute for consultancy or advice. MyHatchTech is designed as a resource to understand HatchTech and its products and services. Unless otherwise agreed any other use of the informational content or proprietary content, including the reproduction, modification, distribution, transmission, republication, or display of the content, in whole or in part, from MyHatchTech is strictly prohibited without the express written permission of HatchTech.
HatchTech makes no warranties or guaranties, express or implied, written or oral, as to the information and content, included in MyHatchTech. HatchTech and its subsidiaries, affiliates, partners, agents, licensors, suppliers and customers hereby expressly disclaim to extent permitted by law any representations or warranties of any kind, including warranties of merchantability, fitness for any particular purpose, non-infringement, or as to the operation of MyHatchTech, the content or user content. The use of, and browsing in MyHatchTech, is at your own risk. Neither HatchTech nor any other party involved in creating, producing, or delivering MyHatchTech is liable for any loss of use, data, goodwill or profits and direct, incidental, consequential, indirect, or punitive damages arising out of the access to, or use of MyHatchTech or any material or information contained in it. To the maximum extent permitted by applicable law, HatchTech is not responsible for any damages or injury caused, to persons or property, due to any breach of contract or warranty, negligence or other legal action, (mis)use of HatchTech products, or due to inaccurate or incorrect data or information contained in MyHatchTech.
HatchTech reserves the right to change, alter or modify the content of MyHatchTech and without prior notice.
HatchTech is allowed to restrict access to MyHatchTech without any prior notice.
In the event that any part of these Terms of Use is held to be invalid or unenforceable, the invalid or unenforceable part shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of HatchTech and the remainder of the provisions shall remain in full force and effect.
These Terms of Use shall be governed by and construed in accordance with the law of The Netherlands.
Any controversy arising out of these Terms of Use shall be resolved exclusively by the competent court in Utrecht, The Netherlands.
